These Terms of Service (“Terms”) govern your use of mobile tire, roadside assistance, and related services (the “Services”) provided by MVP Mobile Tire Shop and Roadside Assistance (“MVP,” “we,” “us,” or “our”) in the Kansas City, Missouri/Kansas metro area and the Tampa Bay, Florida metro area. By requesting, scheduling, or receiving Services from MVP, you (“Customer,” “you”) agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By calling, texting, booking online, or otherwise requesting service from MVP, you confirm that you are authorized to make decisions regarding the vehicle being serviced (as the owner, an authorized driver, or an authorized representative such as an insurance company, fleet manager, or dealership) and that you accept these Terms in full.
2. Services Provided
MVP offers on-site, mobile services including but not limited to flat tire repair, new tire installation, tire rotation, battery replacement, jump start service, fuel delivery, car lockout assistance, winch-out and recovery, and towing. Services are provided at the customer’s location (roadside, home, workplace, or other accessible site) within our published service areas, subject to technician availability, safety conditions, and site accessibility.
3. Scheduling and Appointments
Appointments may be requested by phone, text, or through our website. Estimated arrival windows are provided in good faith but are not guaranteed, as roadside and mobile service timing can be affected by traffic, weather, prior calls, and emergency dispatch priorities. We will make reasonable efforts to notify you of significant delays.
4. Pricing and Payment
Pricing is based on the service requested, vehicle type, parts required, location, and time of day (including any after-hours, holiday, or emergency dispatch fees). Whenever possible, we will provide a quote before work begins. Final pricing may vary if the technician discovers additional issues once on site; any changes will be communicated to you before additional work is performed. Payment is due in full at the time service is completed unless other arrangements (such as insurance billing or fleet account terms) have been agreed to in advance. We accept major credit/debit cards and other digital payment methods as made available at the time of service.
5. Cancellations, Delays, and No-Shows
You may cancel or reschedule a scheduled appointment at no charge if you notify us with reasonable advance notice. If a technician is dispatched or already en route and the appointment is cancelled, or if the technician arrives and is unable to access the vehicle or perform the service through no fault of MVP (for example, a no-show, an inaccessible location, or an unsafe worksite), a dispatch or trip fee may apply.
6. Vehicle Inspection and Pre-Existing Conditions
Before beginning work, our technician may visually inspect the vehicle and the area related to the requested service. MVP is not responsible for pre-existing damage, wear, corrosion, prior repairs, or mechanical conditions unrelated to the specific service performed. If a pre-existing condition is discovered that could affect the safety or success of the requested service, we will inform you before proceeding.
7. Workmanship and Parts Warranty
MVP stands behind the quality of its work. Labor performed by MVP is warrantied against defects in workmanship for a reasonable period following the date of service, and any tires, batteries, or parts installed by MVP carry the applicable manufacturer’s warranty, where offered. Warranties do not cover damage resulting from misuse, road hazards, accidents, improper maintenance, or normal wear and tear. Please contact us promptly if you believe a service performed by MVP was not completed correctly so we can make it right.
8. Limitation of Liability
To the fullest extent permitted by law, MVP’s total liability for any claim arising from the Services is limited to the amount you paid for the specific service giving rise to the claim. MVP is not liable for indirect, incidental, or consequential damages, including but not limited to lost wages, missed appointments, towing storage fees from third parties, or damages resulting from acts of nature, road conditions, or the actions of other drivers. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Towing, Winch-Out, and Recovery Specific Terms
Towing and winch-out/recovery services are provided in accordance with applicable state and local towing regulations. You are responsible for confirming the correct destination address for any tow. MVP is not responsible for items left inside a vehicle during towing or recovery, and we recommend removing valuables before service begins whenever it is safe to do so. Additional charges may apply for extended mileage, extreme recovery conditions (such as off-road recovery, mud, snow, or water hazards), or extended wait times caused by law enforcement, weather, or site hazards.
10. Customer Responsibilities
To help our technicians complete your service safely and efficiently, please provide accurate location information, ensure reasonable access to the vehicle, disclose any known mechanical issues, and remain reachable by phone during dispatch. Customers are responsible for ensuring the safety of the service location to the extent within their control, such as pulling as far off the roadway as safely possible and activating hazard lights while waiting for assistance.
11. Insurance and Third-Party Billing
If your service is being billed to an insurance company, roadside assistance club, warranty provider, or fleet account, you remain responsible for full payment if the third party denies or delays the claim. MVP will provide documentation reasonably necessary to support a reimbursement claim, but is not responsible for the third party’s claims process or timeline.
12. Right to Refuse Service
MVP reserves the right to refuse or discontinue service if a location or situation is deemed unsafe for our technicians or equipment, if a vehicle’s condition makes the requested service unsafe to perform, or if a customer engages in abusive or threatening behavior toward our staff.
13. Dispute Resolution and Governing Law
These Terms are governed by the laws of the state in which the service was performed (Missouri, Kansas, or Florida, as applicable), without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services should first be submitted to MVP customer support for good-faith resolution before pursuing formal legal action.
14. Changes to These Terms
MVP may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
